IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.946 OF 2015 IN CRIMINAL APPEAL NO.652 OF 2015 Hemant Shivaji Dawalkar ..Applicant

Versus

State of Maharashtra ..Respondent ....

Mr. Dipak Girme, for the Applicant.

Mr. A.R. Patil, APP, for the State.

....

CORAM : A. R. JOSHI, J.

DATE : 12th AUGUST, 2015 P.C.

1.

Heard learned Counsel for the applicant. This is an application preferred for passing the orders of suspension of sentence. By earlier order of this Court dated 26th June, 2015 the bail was granted to the applicant during pendency of the appeal which was already admitted on same day. In fact, grant of bail during pendency of appeal amounts to suspension of sentence as there is automatic stay to the sentence awarded against the accused. However, as a separate application is filed today, it is clarified that by the order of granting bail to the applicant vide order dated 26th June, 2015 even the substantive sentence is also stayed. Application is accordingly disposed of. ( A. R. JOSHI, J.) Deshmane (PS) 1 / 1
