Heard learned Counsel for the petitioners, learned counsel for the respondent no.1 and the learned APP.

Learned Counsel for the petitioners states that pursuant to the order dated 19th August, 2016, the petitioners have deposited a sum of

2/3 Rs.2,65,193/- in the Appellate Court.

Learned Counsel for the Respondent No.1 - Bank states that the respondent no.1 - Bank be permitted to withdraw the aforesaid amount of Rs.2,65,193/- which is deposited by the petitioners in the Appellate Court.

Learned Counsel for the Respondent No.1, on instructions of the respondent no.1 states that the respondent no.1 is ready to give their consent for discharge of the petitioners in the Appeal, which is pending before the Additional Sessions Judge, Jaysingpur. 5.

Accordingly, Respondent no.1 is permitted to withdraw the amount of Rs.2,65,193/- which is deposited by the petitioners in the Appellate Court.

The parties are at liberty to file Consent Terms before the Appellate Court.
