Petitioner has approached this court with a grievance that his passport application is not being processed as per law on wrong premise. According to him cognizance of private criminal complaint taken against him, has been set aside by the Sessions Court. As such said application ought to have been proceeded further and passport should have been issued. Learned counsel appearing for respondent No.1(passport authority) submits that complainant before trial court has approached the learned Single Judge of this court in W. P. No.2703/2013 and if that, petition is allowed, the complaint filed by him before the learned JMFC may again - Page-1/2

This court does not have papers of the matter today. However, with consent of the parties we have heard them. Petitioner has to obtain necessary no objection from the court in which matter is pending. In the present facts we find that the case is pending before the learned single Judge. Hence, we permit the petitioner to convert the present petition as interim application in W. P. 2703/2017. Necessary compliance be done within one week from today. With these directions we dispose of the petition.
