The Applicants who are husband and wife, apprehending their arrest in Crime No.62 of 2019 of Wagale Estate Police Station under Section 420, 406 read with 34 of the Indian Penal Code are seeking anticipatory bail.

The Applicant had represented to the complainant to invest amount in the business of import and expert of garments alluring him of huge profits which eventually did not materialize. N.S. Kamble page 1 of 2

The record discloses that on 17 July 2019 an interim protection was granted to the Applicants, inter alia on the condition of the attendance, with the Investigating Officer. 4.

The learned Additional Public Prosecutor on instructions states that the Applicant had attended and co-operated with the Investigating Agency.

She therefore, states that appropriate order may be passed. In such circumstances, the Criminal Application is disposed of in terms of the order dated 17 July 2019, subject to the condition that the Applicant shall co-operate with the Investigating Agency as an when required and shall not tamper with the prosecution evidence/witnesses. In the event of breach of any of the conditions, the bail is liable to the cancelled.
