Perused the order dated 23rd January 2017.

Even on that day, none appeared for the parties and both the parties were absent. Therefore, a notice was issued to the parties directing them to personally remain present in Court. The Respondent wife is present. However, the notice issued to the Appellant is returned unserved with the remark "Appellant is residing at village." The notice is sent at the address mentioned in the cause title of the Appeal. The

As the Appellant and his Advocate are absent, we dismiss the Appeal for non-prosecution.
