These are applications for condonation of delay in filing an application for bringing legal heir of deceased appellant on record as well as application for bringing legal heir of deceased appellant on record.

(35)APPANo.11252018 Appellant Bhimrao Savne was convicted of offences punishable under Section 7 and 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988 and, therefore, he filed the appeal challenging conviction as well as resultant sentence. It is reported that during pendency of the appeal, appellant died on 16/09/2016.

The applicant is widow of deceased appellant Bhimrao Savane. She has placed on record copy of Death Certificate of appellant Bhimrao Savane. Sufficient cause is shown for not filing the application within prescribed period. Hence, the Order :

ORDER

(i) The delay in filing application for bringing legal heir of deceased appellant is condoned.

(ii) Applicant Sumati Bhimrao Sawane being widow of deceased appellant is permitted to prosecute the appeal filed by her deceased husband.
