Heard the learned counsel for the parties.
Though respondent no.1 is duly served no one appeared on behalf of him when the matter was called out.
This application is preferred by claimant for condonation of 220 days delay in filing First Appeal challenging the judgment and award dated 4.9.2012 passed by MACT, Thane in M.A.C.P. No.1220 of 2006.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for Mohite 1/2
27 caf2989-13.doc allowing the present Civil Application. Hence, following order:
A) Civil Application is allowed in terms of prayer clause (a) which read thus:
"(a) the delay of 220 days in filing the First Appeal be condoned and the First Appeal be heard on merits."
B) Civil application stands disposed off accordingly.
