Learned senior counsel Mr.Aabad Ponda fairly states that applicant No.1 has reported to the police station, as directed, but on account of illness, applicant No.2 has failed to report.

It is a categorical statement that applicant No.2 shall report to the Investigating Officer on 10th and 11th October, 2022.

The aforesaid statement is accepted.

Considering the nature of accusations levelled in the subject C.R., which revolve around an agreement and which is a subject matter of arbitration proceedings, the Investigating Officers, PI Sharad Zine and API Hanumant Ohulkar, who are present in the Court, state that subject to the compliance by applicant No.2, custodial interrogation is not necessary. Hence, the following order.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.I-282 of 2021 registered with Khadakpada Police Station, applicant No.1-Anil Chandulal Shah and applicant No.2-Matthew John Kuchin shall be released on bail on furnishing P.R. Bond to the extent of Rs.50,000/- each, with one or more sureties in the like amount. (c) Applicant No.2-Matthew John Kuchin shall report to the concerned police station on 10th and 11th October, 2022 between 2.00 to 5.00 p.m. and, thereafter, both the applicants shall report to the concerned police station, as and when called for.

(d) The applicants shall not directly or indirectly make any inducement, threat or promise to any person

3/3 12 ABA-2120-22.doc acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
