By Order dated 8th March, 2017 the the Registrar (Judicial II) had granted four weeks time to the appellant to file fresh civil application to withdraw the civil application for condonation of delay, failing which the matter would stand dismissed. 2.

The appeal came to be dismissed for non compliance of the said order.

By this application, the applicant has sought to condone the delay of 102 days in filing the application The learned Counsel for pps

In the light of the said statement and in the light of the reasons stated in paragraph 3 of the application, the delay in filing application is condoned. The appeal is restored to the file. 4.
