Learned Advocate for the Appellant on instructions withdraw the Appeal as against Respondent Nos. 2, 3 and 5. 2.
The parties who are now before the Court have entered into the compromise and have filed consent terms on record. The parties are represented by respective advocates. The parties have also verified the terms of the consent terms. By way of consent terms matter is settled between the parties. Consent Terms are taken on record and marked as 'X' for the purpose of the identification. In the consent terms there is also a term to withdraw the appeal against Respondent No. 2, 3 and 5. The consent terms at exhibit-'X' since verified the same shall form part of the Order of this Court. In view of compromise, impugned Judgment and Decree is accepted by the parties and the same is confirmed. The Decree therefore be withdrawn in terms of consent terms as indicated above. 3.
All pending Civil Applications, if any stand disposed of in view of the disposal of the First Appeal.

Necessary amendment be carried out forthwith. 5.
First Appeal No. 58 of 1998 is disposed of.
