The application is filed for bail in C.R. I. No.126/2017 registered at Jaykheda Police Station, Dist: Nashik for offences punishable under Section 306, 323, 504 etc. read with Section 34 of Indian Penal Code. Both the sides are heard. The papers of investigation were made available for perusal. 2.

The crime is registered on the basis of report given by father of the deceased. He has contended that the deceased had an affair with one girl and that was not liked by present applicant. It is contended that in incident dated 23.04.2017 the deceased was given beating by two accused. Prior to that deceased had left home by informing that he was leaving to attend the marriage. The dead body of deceased was found in Antapur on 24.04.2017 in hanging condition. The PM report shows that death took place due to hanging. There is allegation that due to beating given by the present applicant to the deceased he felt insulted and committed suicide. The applicants are behind bar since 05.07.2017. When the dead body was found on 27.04.2017, the FIR was lodged on 05.07.2017 and there is an allegation of aforesaid nature in the FIR against the present Applicants. Due to these circumstances and as it is not certain as to how much time will be required for disposal

habeeb 30-ba-1729-17.doc of the case which may be filed against the present applicants, this Court holds that it is not desirable to keep the applicants behind bar till the disposal of the case. In the result application is allowed. Applicants are to be released on bail on their furnishing PR and SB of Rs.15,000/- to be given by each of them. The Applicants are not to tamper with the prosecution witnesses. They are not to commit similar offence. They are not to enter the place of residence of the village Rajangaon Dist: Chalisgaon were the complainant is living.
