P.C.:- This is an application for bail under Section 439 of the Cr.P.C. filed by the aforesaid Applicant, who has been arrested in Crime No.37 of 2018 registered at Manchar Police Station, DistrictPune, for the offences punishable under Sections 363, 366, 366(A), 376 and 506 of the IPC.

Heard Mr. Uday Nighot, the learned counsel for the Applicant and Mr. S.R. Agarkar, the learned APP for the Respondent No.2-State.

The first informant (prosecutrix) has stated that as on the date of the incident she was 17 years, 11 months and 9 days old. The 1/3

FIR prima facie reveals that the Applicant herein was known to her and that she had accompanied the Applicant on 16th January, 2018 and 17th January, 2018 and that they had physical relationship. The FIR was lodged only after the parents of the victim were informed by the watchman that the Applicant had come to meet the prosecutrix on 21st January, 2018. Considering the nature of allegations and also considering the fact that the Applicant is in custody since January-2018 and that the investigation is completed and the charge sheet is filed, in my considered view this is not a fit case to detain the Applicant pending trial.

Hence, the following order:- (i) The bail application is allowed.

(ii) The Applicant shall be released on bail on furnishing bail bonds of Rs.25,000/- with one or two sureties in the like amount to the satisfaction of the Additional Sessions Judge, Khed, Dist. Rajgurunagar.

(iii) The Applicant shall furnish his permanent address as well as temporary address, if any, and his contact details to the concerned court.

(iv) The Applicant shall not change his residential address without prior intimation to the Investigation Officer. 2/3

(v) The Applicant shall not interfere with victim and other witnesses in any manner.
