Heard learned counsel for both the sides.
Applicant/accused No.2 namely Bhagwan Pamnani, who is stated to be one of the applicants in Anticipatory Bail Application No.819 of 2013, has by this application sought permission to travel abroad from 9th August to 2nd September 2016 to meet his daughter Ankita Pamnani at her address mentioned in paragraph No.4 of the application. Application is also supported with copies of ticket, passport and visa. The learned counsel for the applicant has submitted that one of the co-accused in this Crime, and who is applicant No.1 in Anticipatory Bail Application No.819 of 2013, is allowed to travel abroad by the order of this Court dated 26/08/2014. (34)APPP-610-16 On perusal of record, it appears that while allowing Anticipatory Bail Application No.819 of 2013 of applicant, this Court on 8th August 2013 imposed condition upon applicant not to leave India without prior permission of this Court. The protection orders have been granted to applicant on considering that the officials of Economic Offence Wing had submitted final report which is accepted by concerned Additional Commissioner of Police, wherein it is stated that during investigation it did not reveal that applicant has committed any forgery or cheating. In view of above observations, applicant thus came to be protected.
In the circumstances, application is liable to be allowed as per order below :
(i) Applicant is granted permission to travel to New York via Istanbul from 9th August 2016 to 2nd September 2016. (ii) Before proceeding applicant shall furnish his itinerary and address of his daughter, where applicant shall stay at New York to the Investigating Officer.
(iii) Applicant on his returning to India, shall inform the fact of his returning to India to Investigating Officer.
