By this application the applicant/accused seeks relaxation of the condition imposed of reporting at Bhiwandi Police Station on 2nd and 4th Monday. By the original bail order dated 2-4-2012 the applicant was directed to report at concerned

police station on every Monday. Pursuant to application by the applicant, vide order dated 30-1-2013, said condition of reporting on every Monday was modified and the applicant was ordered to report at concerned police station on every 2nd and 4th Monday. Learned counsel for the applicant submits that said condition may be relaxed as the applicant, though a resident of Andhra Pradesh, has regularly attended the Court. Learned APP objected the prayer by submitting that now evidence at trial is over and only I.O. has remained to be examined. It is submitted that in event of the applicant fleeing away, the entire trial proceedings would be put in jeopardy.

After considering the submissions advanced by the learned APP, it appears that the trial would be over within a period of about 4-6 weeks. Hence, it is difficult to

accede the prayer for relaxation which may involve the applicant reporting at concerned police station on two-three days. The application stands rejected. However, liberty to the applicant to renew the prayer in the event trial being not over within a period of six weeks from today.
