Learned for the applicant submits that the applicant belongs to poor strata of the society and was in jail, due to which, he could not give instructions to file an appeal.

Learned A.P.P strongly objects the prayer.

Even though reasons for delay are not satisfactory, in the interest of justice, the same needs to be condoned in order to hear the appeal on merits.

Application is allowed. Delay is condoned subject to costs of Rs.1000/- to be deposited in the Registry within two weeks. 7.
