Heard Mr.Pramod J.Pawar, learned Counsel for the petitioner and Mr.Sagar Ambedkar, learned Counsel for respondent. 2.

After arguing the petition for some time, Mr.Pawar, upon taking instructions from the petitioner, seeks permission to withdraw this petition with a liberty to move the trial Court for recalling the impugned order dated 06/07/2013 on the ground that after passing of the impugned order, the petitioner has collected documents which has impact on the income of the respondent. Mr.Ambedkar submits that the amount deposited by the petitioner in the Family Court towards arrears of maintenance may be permitted to be withdrawn. In view thereof, respondent is permitted to withdraw the amount deposited by the petitioner in the Family Court unconditionally.

In view thereof, on the motion made by Mr.Pawar, the petition is allowed to be withdrawn with liberty as prayed for. 4.

All the contentions of the respondent on merits including maintainability of such application are expressly kept open. Order accordingly.
