It is stated that, the Appellant No.3 passed away on 13th April, 2021 leaving behind him the Appellant No.3a as his legal heir. There is delay of 150 days in filing the present Application. Perusal of Application would indicate that, sufficient cause is made out for conondation of delay.

In view thereof and for the reasons stated in the Application, delay is condoned, abatement if any, is set aside and the Application is allowed in terms of prayer clauses (b), (c) and (d). 1/2
