Heard learned Counsel for the parties. This miscellaneous civil application seeks transfer of a matrimonial petition for divorce filed by the Respondent-husband and pending before the Civil Judge, Senior Division at Baramati. Transfer is sought to the Family Court at Nashik Road, Nashik. The Applicant-wife has already filed a matrimonial petition for restitution of conjugal rights before the Family Court at Nashik Road at Nashik. This divorce petition has been filed by the Respondent, after he received notice of that petition. Having regard to the nature of the two proceedings as also the fact that some other proceedings of the Applicant-wife have been pending before the Family Court at Nashik Road, Nashik, it is in the interest of justice that the divorce petition filed by the Respondent-husband should be transferred to the Family Court at Nashik Road, Nashik, so as to be heard along with the Applicant's petition for restitution of conjugal rights under the Hindu Marriage Act and the other proceedings.
