1] By an Order dated 28 th July 2017, the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates.

2] Perused the record of investigation.

The record indicates that, the first informant Mr. Govindrao Kakade has received the amount of Rs.9.00 lakhs which is alleged to have been defalcated by the applicant and other accused persons in the present crime. That The Remand Report dated 6.3.2017 submitted that the Investigating Officer before the Metropolitan Magistrate, 66 th Court, Andheri (East), Mumbai corroborates the same. 1/2

aba.1334-2017.doc The learned Counsel for the applicant submitted that the applicant has already paid his share of amount to the complainant and nothing further is to be recovered at his instance. 3] In view thereof, interim relief granted by Order dated 28 th July 2017 is hereby confirmed. However, the condition to attend the concerned Police Station is waived.
