The learned Counsel for Applicant states that notice of this application has already been served upon the Respondent and necessary Affidavit of service has also been filed. Considering the reasons set out in the Civil Application, as also the accompanying medical certificate, case is made out to condone delay and to recall the order dated 06/04/2011 by which the Civil Revision Application came to be dismissed for default. Accordingly, the Civil Application is made absolute in terms of prayer clauses (a) and (b). This shall be subject to the Applicant paying costs of Rs.5,000/- (Rupees Five URS
2 CAC 432-13 in CRA 166-03.doc-2 Thousand Only) in favour of the Respondent. The costs shall be deposited in this Court within a period of four weeks from today. Once deposited, the costs can be withdrawn by the Respondent unconditionally.
