Heard learned Advocate for the Applicant-accused and learned Advocate for Victim and learned APP.

This Court has already suspended sentence as per Order dated 21/07/2023, it was till next date of hearing. At that time, the Respondent-victim was not before the Court. Today learned Advocate for the Victim has brought my attention to the findings in the impugned judgment and relevant evidence. by SEEMA KSHITIJ YELKAR Date:

Whereas Appellant-Applicant's counsel submitted that his client is now married and there are no subsequent untoward incidents. He has also furnished cash bail of Rs. 20,000/- before the trial Court.

I am inclined to confirm the order dated 21/07/2023 only with one modification about furnishing surety instead of cash bail. Hence Order :-

ORDER

(i) Let Order dated 21/07/2023 is confirmed till final disposal of the appeal.

(ii) Let Applicant to furnish Personal Bond and Surety Bond in sum of Rs. 15,000/- before the trial Court within a period of one month from today.

(iii) Once the bail is furnished, the Applicant-Appellant is at liberty to ask for withdrawal of the amount from the trial Court and the trial Court to allow him withdraw that amount.

Interim application is disposed of.
