It is an admitted position that as on date the Applicant, who is seeking an appointment on compassionate basis in place of his mother who retired on superannuation on 21 July 1999, is 60 years old.

The learned Counsel for the Applicant states that though the relief of appointment may not be practicable in view of the age of the Applicant, the manner in which the Applicant's claim has been treated and delayed, the Applicant is entitled to compensation. The learned Counsel states that appropriate amendment incorporating the prayers and pleadings would be sought by filing an interim application and leave may be granted to withdraw the present interim application with liberty to file a fresh interim application. The interim application is allowed to be withdrawn with liberty to file a fresh interim application.
