Versus

State of Maharashtra & Another.

..Respondents.

Mr. R. K. Mendadkar for the Petitioner.

Mr. V. N. Sagare, AGP for the Respondent-State. Coram : RANJIT MORE & PRAKASH D. NAIK, JJ.

Date : February 16, 2018.

P. C. :

1.

Mr. Mendadkar, the learned Counsel for the Petitioner does not dispute that the order impugned in this petition is appealable before the Caste Scrutiny Committee, Nashik. In that view of the matter, we are not inclined to entertain this writ petition. Writ petition is, therefore, dismissed.

2.

At this stage, Mr. Mendadkar submitted that prescribed period of limitation for filing such an appeal is over long back. In our opinion, in this regard, the Petitioner can file an application for condonation of delay occurred in preferring appeal and the Petitioner can take benefit of section 14 of the Limitation Act, 1963.
