Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in connection with C.R.No. 1046 of 2021 registered with Malvani Police Station for the offences punishable under sections 120-B, 420, 441, 447, 465, 467, 468 and 471 of the Indian Penal Code, 1860 ('IPC'). 3.

When the application was listed before the Court on 23rd 1/3

September 2021, this Court was persuaded to grant interim protection observing inter-alia that the allegedly forged Memorandum of Understanding has been cancelled. The encroachment over the land is removed and the Government has resumed possession of the subject land.

Learned APP, on instructions of the Investigating Offcer, informs the Court that in terms of the directions contained in the order dated 23rd September 2021, the applicant had appeared before the Investigating Offcer.

In the aforesaid view of the matter, at this length of time, further custodial interrogation of the applicant does not seem to be warranted. Investigation seems to be complete and chargesheet has been fled. 6.

Hence, the following order :

O R D E R

(i) The order of interim bail dated 23rd September 2021 is made absolute on the terms and conditions incorporated 2/3

therein.

(ii) The applicant shall regularly attend the proceedings before the jurisdictional Court.

(iii) The Application is disposed.
