We find that this petition has been filed at the stage when the enquiry report has been submitted before the Disciplinary authority and the Disciplinary Authority has agreed to the findings recorded in the enquiry report. It is not in dispute that as on date no order of penalty has been passed against the petitioner. In the circumstances, we feel that this petition is premature. In the circumstances, with a liberty to the petitioner to take appropriate proceedings, if occasion so arise, we allow the petition to withdraw this petition.
