Issue notice to respondent. The learned Additional Public Prosecutor accepts notice on behalf of respondent/Stat Learned counsel for the applicant has tendered on record Hindi typed copy of document Exhibit D on page no.27. Heard.

This is an application filed by applicant apprehending his arrest in Crime No.115 of 2014 registered by Imamganj Police Station, District Gaya, State of Bihar. Learned counsel for the applicant has submitted that since applicant was not aware of such proceedings, alleged to be filed against him, he did not remain present before the Court of Gaya District Judicial magistrate, and in that background, on application made by Investigating Officer

R.D.Gaikwad 2/2 (913)ABA-1337-16 for issuance of warrant, warrant is issued against applicant, and thus, he apprehends his arrest on execution of same. It is, therefore, prayed that applicant be protected by transit bail, so as to enable him to attend before the Court, and file application for cancellation of NBW, and to surrender.

On perusal of typed copy produced on record, name of accused mentioned therein are as follows : Accused no.1 : Najir Miyan Pi. Safiq Miya Accused No.2 : Chotu Sah Pi. Salim Sah.

On perusal of name of applicant as mentioned in title of this application is Mohd.Nazir Ansari.

In that view of the matter, there is absolutely no relevancy, nor anything on record to establish that non-bailable warrant is issued against the applicant as such. In that view of the matter, there is no substance in the application. Application stands disposed of as rejected. (P.N. DESHMUKH, J)
