Heard. This Application is preferred by the claimant for releasing the amount invested by the Trial Court in a fixed deposit account, as per award dated 16/07/2001.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which read thus:

2901.14-caf a) This Hon'ble Court may pleased to issue appropriate direction for releasing the amount invested in fixed deposits in the name of Applicant No.1 in the State Bank of India Rasayani Branch and in the name of Applicant No.3 in Bank of India New Panvel Branch as per the judgment and award passed by the learned Member of MACT, Raigad dated 16/07/2001, in MACP No.459/1995.

b) Civil application stands disposed off accordingly.
