Heard learned counsel for the applicant and learned APP. 2.
Learned counsel for the applicant submitted that this court had disposed of the application of applicant stating that, if trial has not commenced before September, 2021 applicant has liberty to file a fresh bail application before the trial court. Summons have been issued to the witnesses, but trial has not been commenced. 1/2

Learned APP submitted that trial has commenced and summons are issued to the witnesses.

I have heard both learned counsel. This court (Coram: S. K. Shinde, J) while passing order dated 25th February, 2021 has disposed of bail application filed by the present applicant on merits. Only liberty was granted to file bail fresh application, if trial has not been commenced. The summons are issued to the witnesses. 5.
It is contention of learned counsel for the applicant that applicant is behind bar for more than five years. Hence trial court is requested to conclude the trial as early as possible preferably within ten months after receipt of the order.

Accordingly, application is disposed of.
