Heard learned Advocates on both sides. The learned Advocate for the applicant makes a statement that he has already deposited Rs.50 lakhs on 21st August, 2015 in this court, and has thus complied with the condition in para 5 of the order dated 13th July, 2015.

Learned Counsel for the applicant further submits that the applicant is ready and willing to deposit Rs.35,000/- each towards cash surety as pps 1 /2
323-15-appln directed in paragraph 4 of the order dt. 13th July, 2015. He submits that he was unable to deposit the same since the court wherein the matter was initially being tried has closed down and though the proceedings are sent to the Chief Metropolitan Magistrate, Mumbai, they are not yet alloted to any other court. In view of this factual aspect, he seeks leave to deposit the amount of Rs.70,000/- before this court within a period of one week. 3.
In view of the above, the applicant and the surety are permitted to execute the bail bonds and to deposit Rs.35,000/- each before the Registrar (Judicial) of this Court within a period of one week. The Registry is directed to invest the said amount in fixed deposit with any nationalized bank, initially for a period of one year and thereafter to renew the same until further orders.
