Vide order dated 24.4.2023 this Court (Coram: Amit Borkar, J.) had directed Criminal Appeal No.774/2019 pending before the Sessions Court to be decided within three months from 24.4.2023.

Learned counsel for the Applicants states that the parties have settled the matter and the Applicants have made payment of Rs.5 Lakhs out of Rs.35 Lakhs. He states, on Deshmane(PS)

21-IA-2591-23.odt instructions, that the balance amount of Rs.30 Lakhs would be paid within a period of 45 days from today and, therefore, time to decide the appeal be extended by a period of 45 days.

Learned counsel for the Respondent No.2 has left the issue of extension of time to be decided at the discretion of the Court.

Considering the statements made by both the parties and to enable the Applicants to honor their commitment, the period to decide Criminal Appeal No.774/2019 pending before the Court of Sessions at Greater Bombay is extended by a period of 45 days from today, by way of a last chance.

With these directions, the Interim Application is disposed of.
