Having regard to the contention that in spite of charge sheeted accused No.2 who was allegedly armed with weapon during the incident has been released on bail by Court of Session vide order dated 15-06-2013 and the applicants having prayed for bail on the principle of parity before Vishal 1/2

909-ba-1787-2014 the Court of Session, the Court of Session has bypassed the said submission and without ascribing any reasons for not accepting the said contention has rejected the application preferred by the applicants, the application is disposed of with liberty to the applicants to re-approach the Court of Session to prefer application for bail claiming parity with charge-sheeted accused No.3.

In event of such application being preferred, the Court of Session shall decide the merits of the contention of the applicants of being entitled for bail on principle of parity on its own merits. The application to be disposed of at the earliest and in any event within four weeks of preferring of such application.

Application stands disposed of.
