P.C.:- 1) The Applicant is apprehending arrest in CR No. 162 of 2018 dated 21/5/2018 registered with Sahar Police Station, Mumbai under Sections 465, 468, 471, 420 read with Section 34 of the Indian Penal Code.
2) Heard learned Counsel for the applicant and the learned APP for the State. Perused the charge-sheet and record of investigation.
3) The prosecution case, in brief, is that co-accused Omprakash Yadav accepted certain amounts from two victims and provided them fake visas and documents of immigration for going to 1/3
United Arab Emirates. The said co-accused Omprakash Yadav was arrested by the police and now has been released on bail. After completion of investigation, the police have submitted charge-sheet against the said accused person.
4) The role attributed to the applicant is that, at the instance of Omprakash he arranged two air tickets for the said two victims. The applicant is working as a travel agent and it is his profession to arrange for air-tickets for his customers. Prima facie from the chargesheet it appears that no other overt act is attributed to the applicant. 5) In view thereof, the applicant can be protected by prearrest bail. Hence, the following order.
a) In the event of arrest in CR No. 162 of 2018 dated 21/5/2018 registered with Sahar Police Station, Mumbai the Applicant shall be released on bail on his/her furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount. b) The Applicant shall attend the Investigating Officer as and when called for between 11:00 a.m. to 1:00 p.m. on receipt of notice under Section 160 of 2/3
Cr.P.C. and join the process of investigation till submission of final report qua him.
c) The Applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
