The matter was heard on the last occasion at the behest of the applicant who is seeking pre-arrest bail in Crime No.I462 of 2015 registered with Vakola Police Station for the offences punishable under Sections 419, 420, 465, 467, 468, 471 read with Section 34 Indian Penal Code and Section 66, 66A and 66D of the Information Technology Act. 2).

The learned APP, on the last occasion, has brought to

Rane * 2/2 * ABA-1342-2016 Monday,5.12.2016 sr.no.13 the notice of this Court about the criminal antecedents of the applicant. Having regard to the antecedents, the applicant's Account is already seized in an offence at Bangalore of similar nature. The learned APP, has also pointed out about his intention to avoid co-operation in investigation in the present case, as though the applicant is granted ad-interim protection by this Court.

As such, the applicant pursuant to the State Amendment, upon request of the learned APP was directed to remain present before this Court. The learned Counsel, upon instructions, submits that the applicant is not present pursuant to the last order of this Court and has shown his inability to make further submissions qua his presence. 4).

Looking to the above referred conduct of the applicant and the fact that there is sufficient material to infer primafacie involvement of the applicant in the serious crime in question, the Bail Application is rejected.
