1) Heard. This is an application under section 438 of the Code of Criminal Procedure, 1973. Applicant is apprehending her arrest in crime no. 430 of 2016 registered at Solapur Rural Police Station for offence punishable under sections 307, 504, 506, 143, 147, 148 & 149 of the Indian Penal Code. 2) It appears from the first information report that on 2.7.2016, a report was lodged at Solapur Police Station by one Anusaya Maske alleging therein that on 1.7.2016, there was a quarrel between the family of the ism

2 901.1345.16 aba complainant and the family of the present applicant. It is alleged that some of the people were injured in the said incident. The specific role attributed to the present applicant is that she had abused the family of the complainant and had thrown chilli powder in the eyes of Samadhan and Mahadev. 3) The incident is dated 01/07/2016 and at that time, the applicant herein was carrying pregnancy of 9 months. She has delivered a child on 14/07/2016. In view of this, custodial interrogation of the applicant would not be imperative as the only allegation against her is that she has thrown chilli powder in the eyes of Samadhan and Mahadev. Hence, following order.

O R D E R

1) Application is allowed.

2) In the event of arrest, applicant be enlarged on bail on furnishing P.R. bond in the sum of Rs. 15,000/- with one or two sureties in the like amount. 3) Applicant shall report to the concerned police station as and when called.

4) Application stands disposed of.
