The first grievance of the petitioner is that F.I.R. bearing C.R. No64/2014 was registered with Ashta police station, District Sangli for offence punishable under section 395 of Indian Penal Code. It is submitted that the chargesheet has been filed in the concerned Court for offence punishable under section 324 of Indian Penal Code. Counsel for the petitioner submits that from the charge-sheet, an offence punishable under section 395 of Indian Penal Code is also made out.

Needless to mention that while framing the charge, the trial Court shall go into the entire charge-sheet and accordingly frame the charge.

The next grievance of the petitioner is that the petitioner was assaulted again after the first incident. He filed complaint to the police and F.I.R. No.95/2014 is registered on 3rd July, 2015 but the investigation is not carried out. 4.

Learned APP for the State submits that in respect of the said F.I.R. investigation is complete and 'A' summary has been filed.

Keeping all issues on merits open, the petition is disposed of.
