DATED : 20th OCTOBER, 2022 P.C:- The learned counsel for the applicant relied upon the order passed by this Court in case of co-accused Nanu @ Ramnarayan Haridwar Vishvakarma, and Nedipenti Bhaskra Rao, the co-accused in C.R.No.I-154/2020 and on the last date, the learned APP was asked to ascertain whether the applicant is entitled for parity.

The learned APP Mr.Gavand, on perusal of the two orders passed on 15/6/2022 and 7/7/2022 fairly state in presence of the Investigating Officer, Mr.Surwade, who is present in the Court, that the applicant is entitled for the same protection and rather the role attributed to him is miniscule as compared to the

2/3 20 BA 3365-21.doc other two accused persons who are released on bail. In the wake of the aforesaid statement, I am inclined to extend parity to the present applicant. Hence, the following order :-

O R D E R

(a) The Applicant - Yadul Shankar Ushala @ Aadi Anna in connection with C.R.No.154/2020 registered with Chitalsar Police Station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

The applicant shall be released on provisional cash bail of Rs.25,000/- in lieu of sureties for a period of six weeks. During the said period, the applicant shall arrange for the sureties. (b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer. The Applicant should not tamper with evidence.

(c) The applicant shall mark his attendance with the concerned police station on 1st Monday of every trimester between 3.00 pm to 5.00 pm.

3/3 20 BA 3365-21.doc (c) The Applicant shall attend the trial on regular basis.

(d)On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, if there is any change.
