Civil Application No. 4908/2016 is taken out by the applicant seeking relief of withdrawal of the amount deposited as Court fee and statutory deposit.

The applicant challenged the judgment of the M.A.C.T., Thane, passed in M.A.C. No. 416/2006 by way of appeal, which came to be withdrawn by the applicant. However, though the appeal was withdrawn, inadvertently no prayer for refund of Court fee and statutory deposit was made. Sonali Patil

In light of the undisputed fact stated in the application, application is allowed in terms of the prayer clause (a).
