IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO. 1137 OF 2018 In CRIMINAL APPEAL NO. 635 OF 2015 Salim Hayatchand Nadaf ... Applicant/Appellant Vs.
The State of Maharashtra ... Respondent Mr.Umesh Mankapure, for the Applicant/Appellant. Ms.S.V.Sonawane, APP for Respondent-State.
CORAM : S. S. SHINDE & A. S. GADKARI, JJ.
Date : October 10, 2018.
P.C. :
Heard learned counsel appearing for the Applicant and the learned APP for State. Perused the notes of evidence and in particular evidence of the eye-witnesses, one of which is the injured eye-witness. Medical evidence is in consonance with the version of the eye-witnesses. Prima facie we find the reasons and findings recorded by the trial Court in consonance with the evidence of eyewitnesses. No case is made out to entertain the Application for releasing the Applicant on bail. Hence Application stands rejected. Liberty to the learned counsel appearing for the Appellant to mention the Appeal for 'final hearing' after Deepavali vacation 2018. (A.S.GADKARI, J.) (S. S. SHINDE, J.)
