The Applicant has filed an affidavit showing willingness to discharge his earlier Advocate Mr.Narendrakumar Ram Aachal Sharma and he has engaged Advocate Mr.Raghuvendra Mehrotra. In such circumstances, the appearance of Advocate Mr.Sharma is discharged.

The Applicant apprehending arrest in Crime No.330 of 2018 registered at Sakinaka Police Station, Mumbai under Section 420 of Indian Penal Code, is seeking anticipatory bail. 4.

The record discloses that the applicant was granted interim protection on 1 August 2019 which is operating till today. 5.

I have heard the learned counsel for the applicant and the learned Additional Public Prosecutor.

The learned counsel for the applicant states that the applicant had only introduced the complainant to Classic Garments from Banglore and it is on account of the dispute between the complainant and Classic Garments about the delivery of the jeans that the present complaint has been filed.

It is submitted that the applicant was only a middleman and has no concern inter say between the complainant and Classic Garments. In any event, the learned counsel pointed out that the parties are exploring possibility of a settlement and some amount is paid to Classic Garments.

Having heard the learned counsel for the parties and further having regard to the nature of the offence, the submissions N.S. Kamble page 2 of 3

made and the fact that the interim protection is operating from 1 August 2019 and the applicant has co-operated with the Investigating Agency, the Criminal Application is disposed of in terms of the order dated 1 August 2019 subject to the condition that the applicant shall co-operate with the Investigating Agency as and when required. The Criminal Application is disposed of in the aforesaid terms.
