1] The learned APP, in furtherance of the order dated 07.09.2022, on instructions fairly states that the condition imposed of reporting in person on each occasion coupled with communication of travel itinerary to the Investigating Officer through electronic media was never contemplated when the order dated 26.04.2022 was modified. She also fairly conceded to the fact that deposit of passport with the Investigating Officer was never a condition imposed upon the Applicant while releasing on bail.
Condition No.4 imposed in the order dated 15.0.7.2022 was never a part of the condition subject to which the Applicant was released on bail.
2] In the wake of above, let the Applicant abide by the conditions 1/2
(915)APPLN-270-2022.doc imposed upon him by order dated 26.04.2022, particularly condition Nos.3 and 4. He shall inform the Investigating Officer about his itinerary and date of travel and return by any possible mode of communication including email, WhatsApp, SMS etc. He is exempted from personally reporting to the Investigating Officer as directed in the order dated 15.07.2022.
3] As far as deposit of Passport is concerned, since this was never condition of his release, he is also absorbed from this condition of depositing the passport when he returns from abroad. 4] With the aforesaid clarification, the order dated 15.07.2022 is upheld.
