1] The learned APP states that on 12.05.2022 notice under Section 41-A of the Cr.P.C. was issued to the complainant. 2] Learned counsel for the Applicant invited my attention to the statement of the Applicant which was recorded on 21.04.2022 pursuant to the notice issued ot him on 25.03.2022.

3] The learned APP has clarified that the notice was issued prior to 1/2

(26)ABA-2148-2022.doc registration of subject FIR and after its registration a fresh notice has been issued.

4] Let the Applicant respond to the notice and report to the Investigating Officer within a period of 7 days from today. Upon his attendance, the Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C., and record reasons in writing in case he is desirous of effecting arrest of the Applicant.

The Investigating Offficer shall also give advance notice of 72 hours in case he comes to the conclusion that custodial interrogation of the Applicant is necessary.

5] With the aforesaid directions, Application is disposed off. IA is also disposed off.
