The Learned Counsel for the parties tender Consent Terms bearing today's date i.e. 11.08.2015 evidencing the settlement arrived at between the parties. The Learned Counsel pray that the Petition be disposed of in terms of the said Consent Terms. The Consent Terms has been signed on behalf of the Petitioner by the authorised Director Mr. Manoj Tharkude as also by the two other Directors. In so far as Ms. Vaishali Tharkude who was the guarantor, it is signed by her Power of Attorney Mr. Manoj Tharkude. On behalf of the Respondent No.1 Bank, the Consent Terms have been signed by Mr. P. G. Gore, the authorised officer. When put in the box and queried Mr. Manoj Tharkude states that the said Consent Terms are acceptable to the Petitioners and that he has BGP.

The authorised officer also states that the Consent Terms are acceptable to the Respondent No.1 and they have been signed by him pursuant to the authorisation given to him by the Respondent No.1. The Consent Terms which are paginated from 1 to 12 are taken on record and marked as 'X' for identification. The Petition is disposed of in terms of the Consent Terms. [R.M. SAVANT, J] BGP.
