Heard. Adv. Mr. Mishra states that he received instructions to appear on behalf of the Respondent. He undertakes to file his appearance. Undertaking is accepted.

This Application is made by the claimant for condonation of 25 days delay in preferring the appeal challenging the award dated 07/02/2014 passed by MACT, Mumbai in Application No.3124/2008.

The learned counsel for the Respondent submits that the Applicant has not shown sufficient cause for condonation of delay. Hence, there is no Basavraj G Patil 1/2

16.1152.15-caf substance in the Civil Application. Same be dismissed with costs.

Considering the submissions made by the learned counsel for the Applicant and the averments made in paragraph 4 of the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. 5.

Hence, the following order:

a) Delay in preferring the First Appeal challenging the award dated 07/02/2014 passed by MACT, Mumbai in Application No.3124/2008 is condoned.

b) Civil application stands disposed off accordingly.

c) Office is directed to place the First Appeal on board on 11/01/2016, for admission.
