The Applicants, apprehending arrest in connection with investigation of Crime No.1245/2019 Bandra Railway Police Station under Section 384 r/w. 34 of IPC, are seeking anticipatory bail.

The Applicants are Police Officers attached to Bandra Railway Police Station and the allegation is that the Applicants while taking action against Deepak @ Ashutosh Dixit and Atul Dixit who were traveling by train, had extorted an amount of Rs.4,000/-, a digital camera and perfume from them. I have heard the learned counsel for the Applicants and the learned APP. It transpires that the Applicants are still attached to the concerned Police Station and are discharging their duties. The record discloses that on 22 July 2019, an interim protection was granted to the Applicants on condition of attendance with the concerned Police Station on 29 July 2019, 30 July 2019 and 31 July 2019.

Learned APP states that the Applicants have co-operated in the investigation.

In that view of the matter, the Application is disposed of by confirming the order dated 22 July 2019 subject to the condition that the Applicants shall co-operate with the Investigating Agency as and when required and shall not tamper with the prosecution evidence and witnesses.
