P.C.:- This is an application for bail under Section 439 of the Cr.P.C. filed by the aforesaid Applicant, who has been arrested in Crime No.178 of 2018 registered at Kharghar Police Station, Navi Mumbai, for the offences punishable under Sections 306 and 498 A of the IPC.

Heard Mr. Nitin Sejpal, the learned counsel for the Applicant and Mr. S.S. Pednekar, the learned APP for the RespondentState. 3.

The FIR and the other material on record prima facie reveals that the Applicant was married to Akshada (deceased) on 23rd April, 2014. The material on record prima facie reveals that the Megha 1/2

Megha 17_ba_1771_2018.doc Applicant had extra marital affair and that he used to talk to the said lady in presence of his wife and that she had committed suicide because of the extra marital affair of the Applicant. Considering the nature of the allegations and also considering the fact that the Applicant is in custody since 10th May, 2018, and that the investigation is completed and the charge sheet is filed, presence of the Applicant is no longer required in custody.

Hence, the following order:- (i) The bail application is allowed.

(ii) The Applicant shall be released on furnishing bail bonds of Rs.25,000/- with one or two sureties in the like amount to the satisfaction of Ad-hoc Additional Sessions Judge-1, District-Raigad Alibag.

(iii) The Applicant shall furnish his permanent as well as temporary address, if any and his contact details to the concerned Investigation Officer.

(iv) The Applicant shall not change his residential address without prior intimation to the concerned Investigation Officer.
