The present application is filed prior to filing of the chargesheet. The learned APP on instructions from the Investigating Officer submitted that the test identification parade is yet to be conducted. In view of the same, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to file a fresh bail application before the trial Court, after either the charge-sheet is filed or the right under section 167 (2) of Cr.P.C. is accrued in his favour.

Leave and liberty granted.

The application is dismissed as withdrawn.
