This is an application for condonation of delay of 117 days in preferring an application for leave to appeal challenging acquittal of the respondent Nos.1 to 3 of offences punishable under Section 323, 504 and 506 read with Section 34 of the Indian Penal Code.
Heard the learned Counsel appearing for respondent Nos.1 to 3. He vehemently opposed the application by contending that no sufficient cause is shown for this inordinate delay in filing Gaikwad RD 1/2
(34)APPLNNo.3712018 the application for leave to appeal and, therefore, the application deserves to be rejected.
Averments made in the application are on affidavit. They reflect sufficient cause. There is no counter to the averments made in the application. Therefore, the following Order :
ORDER
(i) The Application is allowed.
(ii) The delay in filing the application for leave to appeal is condoned.
