This is an application seeking condonation of delay in filing the Revision Application challenging therein the framing of charge against the present applicant for the offence punishable under Section 376 of IPC. The delay is of 46 days.

The learned counsel for the applicant orally submits that the applicant is in jail and he had no knowledge that charge was framed against him under Section 376 of IPC. There was lack of communication between the counsel representing him and the applicant and therefore there is delay.

Taking into consideration the submissions of the learned counsel and in the interest of justice, the application deserves to be allowed. Delay of 46 days deserves to be condoned. Application is allowed in terms of prayer clause (b). Application stands disposed of. Application be listed on 7.9.2015.
