Heard learned counsel for the Applicant - original accused No.2 and the learned APP for the State.

The Applicant has been mainly convicted under Section 302 read with Section 34 of the Indian Penal Code for causing the death of Arjun. The Applicant is now seeking bail. 3.

There is no eye witness to the incident. The only evidence against the Applicant is recovery of the shirt of the deceased at his instance. Looking to this fact and the facts and circumstances of this case, we are inclined to grant bail to the Applicant. Hence, the following order :

The Applicant to be released on bail in the sum of

2/3 Rs.25,000/- with one surety in the like amount. During the period that the Applicant is on bail, he shall report to Hadapsar Police Station, Pune once in a month i.e. on the first day of every month.

The Application is allowed in above terms.
