This application is seeking for modification of condition imposed by this court while releasing him on bail. The applicant was involving in the offence punishable under Section 302 of the Indian Penal Code. This court has released applicant on bail vide order dated 10th December, 2019, with a rider that he should not enter within the jurisdiction of Revdanda Police Station till conclusion of the trial. 2.

It is submitted that the applicant is 58 years old and from his release he is staying elsewhere with somebody else. The applicant's agricultural land situates within the jurisdiction of Revdanda Police Station. The applicant has no other source of income. It is the submission that during last 2 and 1⁄2 years even charges have not been framed. In view of that, the above condition is sought to be relaxed.

The State as well as learned counsel appearing for informant opposed the prayer. It is submitted that in past 10 offences were registered against the applicant. It reveals from the record that most of the offences were under Prohibition Act. Admittedly after release of application on bail, no offence has been registered against him. Till date charges are not framed. Certainly trial will take long time for its disposal. Having regard to said fact, condition No.3 regarding not to enter within the jurisdiction of concerned police station is hereby cancelled.

While granting bail one another condition was imposed that applicant shall attend nearest police station once in a month where he proposed to stay. In view of waiving of condition No.3 henceforth applicant shall attend concerned Revdanda Police Station on every alternate Sunday in between 10.00 a.m. to 12.00 noon till conclusion of trial.

Application stands disposed in above terms.
